The conveyancing process in Spain differs significantly from the process in the UK or Ireland. Understanding each step helps foreign buyers navigate their purchase with confidence and avoid costly mistakes.
Step 1: Obtain Your NIE
The NIE (Numero de Identidad de Extranjero) is a mandatory tax identification number for any foreigner buying property in Spain. Without it, no transaction is possible. Applications can be made at the Spanish consulate or in Spain at the national police. Allow 2 to 6 weeks.
Step 2: Legal Due Diligence
Once you find a property, thorough legal checks are essential before committing:
- Nota simple from the Land Registry: confirms ownership and charges
- Town hall planning verification: urban compliance
- Community of owners certificate: confirming no debts
- Energy efficiency and habitation certificates
- Cadastral check: matching the property description to reality
Step 3: The Deposit Contract (Arras)
The contrato de arras is the Spanish equivalent of exchanging contracts, but with key differences. The deposit is typically 10%. If the buyer withdraws, the deposit is lost. If the seller withdraws, they must return double. There is no statutory cooling-off period as in the UK.
Step 4: Completion at the Notary
The purchase deed (escritura publica de compraventa) is signed before a notary. Payment is made by banker’s draft. The notary verifies identities but does not conduct legal checks — that is your lawyer’s role.
Step 5: Post-Completion
