Expert guidance on buying property spain conveyancing from Tomas Ballestero Lawyers — with over 20 years of experience helping foreign nationals navigate the Spanish legal system from our office in Jávea, Costa Blanca.

Buying property in Spain is an exciting step, but the conveyancing process involves multiple legal stages that must be completed correctly to protect your investment. From the initial offer through to registration at the Land Registry, each step requires professional legal oversight to ensure the transaction is secure and fully compliant with Spanish law.

Stage 1: Reservation and Initial Checks

Once you have found a property, the first step is typically to pay a reservation deposit to take the property off the market. Before this payment, your lawyer should conduct preliminary checks to verify the property’s legal status, confirm there are no outstanding debts or legal issues, and ensure the seller has the legal capacity to sell. This early due diligence can prevent costly problems later.

Stage 2: The Private Purchase Contract

After the initial checks, both parties sign a private purchase contract (contrato de arras). This contract sets out the agreed price, the payment schedule, the completion date, and the consequences of either party withdrawing. Under Spanish law, if the buyer withdraws, they lose their deposit; if the seller withdraws, they must return double the deposit. Your lawyer reviews and negotiates this contract to protect your interests.

Stage 3: Full Due Diligence

Between signing the private contract and completion, your lawyer conducts comprehensive due diligence. This includes obtaining a current Land Registry note to verify ownership and check for charges, confirming that the property has valid building and habitation licences, reviewing community of owners regulations and debts, and verifying that all property taxes are up to date.

Stage 4: Completion Before the Notary

The purchase is completed when both parties sign the public deed of sale (escritura pública) before a Spanish notary. The buyer pays the remaining balance, typically by banker’s draft, and receives the keys. The notary verifies the identities of both parties, confirms the legality of the transaction, and authorises the deed for registration.

Stage 5: Registration and Taxes

After completion, your lawyer registers the property in your name at the Land Registry, pays the applicable transfer tax or VAT, and handles any other administrative requirements. Registration is essential to protect your ownership rights against third-party claims.
