As a non-resident seller, you are subject to a 19% Capital Gains Tax on the profit from the sale. The buyer is legally required to retain 3% of the total sale price and pay it directly to the Spanish Tax Authority (Hacienda) as an advance toward your CGT liability. If your actual tax is less than the 3% retained, you can apply for a refund. Additionally, Plusvalía Municipal (local land value tax) applies based on the cadastral value increase during ownership.
What is the 3% retention and how does it affect UK sellers?
When a non-resident sells property in Spain, the buyer must withhold 3% of the total sale price and remit it to Hacienda on your behalf as a guarantee against your Capital Gains Tax obligation. For example, on a £250,000 sale, approximately £7,500 would be retained. After filing your CGT return (Form 210), if your actual tax is lower, you can claim the difference as a refund. Your lawyer handles the entire filing and refund process.
What documents do I need to sell my property in Spain as a British citizen?
You will need your NIE (Número de Identidad de Extranjero), the original title deed (Escritura), a current Nota Simple from the Land Registry, an up-to-date IBI receipt (local property tax), the Energy Performance Certificate (Certificado Energético), community fee payment receipts if applicable, proof of any mortgage cancellation or outstanding balance, and your valid British passport. Has Brexit affected the process of selling property in Spain for UK citizens?
Brexit has not fundamentally changed property ownership rights or the selling process for British citizens in Spain. You can still sell freely. However, as a third-country national post-Brexit, the Capital Gains Tax rate for UK sellers is now 19% (the same as for all non-EU residents). The entire process from listing to completion generally takes 3 to 6 months on the Costa Blanca.
What are my UK tax obligations after selling Spanish property?
You must report the capital gain from your Spanish property sale to HMRC. Under the UK-Spain Double Taxation Convention, you can claim tax relief for Capital Gains Tax already paid in Spain, preventing double taxation. The gain is reported in your Self Assessment tax return. We recommend consulting a UK tax adviser for proper reporting.
