Can I Inherit Property in Spain as a Non-Resident?

Yes, you can. Non-residents have exactly the same right to inherit property in Spain as Spanish residents. Your nationality or country of residence does not prevent you from inheriting — but you must follow the Spanish probate process and pay Spanish inheritance tax, even if you never set foot in Spain.

What Do Non-Resident Heirs Need to Do?

  • Obtain a Spanish NIE number — mandatory for all heirs, even non-residents
  • Appoint a lawyer in Spain — with a Power of Attorney, your lawyer handles everything without you needing to travel
  • Pay inheritance tax in Spain — non-EU residents used to pay much higher rates, but since 2014, all heirs (EU and non-EU) can apply the regional tax reductions of the Comunidad Valenciana, which are very favourable
  • Sign the inheritance deed before a notary (your lawyer can do this on your behalf with Power of Attorney)
  • Register the property in your name at the Land Registry

Do I Have to Pay Tax in Both Countries?

Potentially, but most countries have mechanisms to avoid double taxation. The UK, Netherlands, France, Belgium, and many other countries allow you to offset or deduct the inheritance tax paid in Spain. Your lawyer should coordinate with your home-country tax advisor to minimise your total tax burden.

Can I Sell the Property Without Going to Spain?

Yes. Once the inheritance is complete and the property is registered in your name, you can sell it entirely through your Spanish lawyer using a Power of Attorney. Many of our clients inherit and sell without ever visiting Spain.
