Why Irish buyers need an independent Spanish property lawyer

Spanish conveyancing differs significantly from the Irish system. There is no equivalent of the Irish solicitor-led closing, and the estate agent or developer does not protect the buyer’s interests. An independent lawyer is essential to carry out due diligence, review the contract and ensure the purchase is legally sound. Due diligence — checks before you commit

Before any deposit is paid, we obtain the nota simple from the Land Registry to confirm ownership and any charges, check that the property is free of debts, that planning and habitation licences are in order, and that community fees and local taxes are up to date. We review the reservation contract and the contrato de arras (deposit contract) before you sign anything.

NIE — your Spanish identification number

Every foreign buyer needs a Spanish NIE (Foreign Identification Number) to complete a purchase. We obtain the NIE for Irish buyers as part of the process, including via power of attorney where you cannot attend in person.

Completion and the Spanish Land Registry

Completion takes place before a Spanish notary with the signing of the escritura pública (title deed). We then register the property in your name at the Spanish Land Registry, which is the step that secures your legal ownership. We manage the notary appointment, the completion and the registration from start to finish.

Many Irish buyers complete their purchase without travelling to Spain. Through a Power of Attorney signed before a notary in Ireland and legalised with the Hague Apostille, our office can carry out the purchase on your behalf — from NIE to signing the title deed and registration.
