Step 1: Complete the Spanish Inheritance
Before any sale, the inheritance must be fully settled. This involves accepting the inheritance before a Spanish notary, paying inheritance tax within the 6-month deadline, and registering the new ownership at the Land Registry (Registro de la Propiedad). Without this registration, no sale is legally possible.
Step 2: Verify the Property’s Legal Status
Before listing the property, essential checks must be carried out:
- Nota simple from the Land Registry confirming no outstanding charges or mortgages
- Urban planning compliance and habitation certificate (cedula de habitabilidad)
