Who Pays?
In Spain, the heir pays inheritance tax, not the estate. This differs from the UK system. You are personally liable regardless of residency or nationality.
How Is It Calculated?
Value of inherited assets, minus personal allowances based on relationship to deceased, then progressive tax rate, then multiplier based on pre-existing wealth and kinship group. Effective rates vary enormously case to case.
Allowances in the Valencian Community
Group I (children under 21) and Group II (children over 21, spouse, parents) get the most generous allowances. Groups III and IV receive less. Amounts change frequently — check current figures.
Main Residence Reduction
Close relatives inheriting the deceased main residence may qualify for a significant reduction. Heir must typically keep the property for 5 years.
Non-Resident Heirs
Following EU case law and Spanish reforms, non-residents now apply the same regional reductions as residents. This substantially reduced the tax burden. Claiming correctly requires careful legal guidance.
Filing Deadlines
Six months from date of death. Six-month extension possible if requested within first five months. Late filing: penalties of 5-20% plus interest.
Double Taxation
You may face tax in both Spain and the deceased country. Spain has few inheritance tax treaties (UK-Spain is one). Where no treaty exists, limited credit for foreign tax paid. Cross-border tax advice is essential.
Planning Ahead
Make a proper Spanish will, consider choice of law under EU Regulation 650/2012, understand available allowances, and explore lifetime gifts where appropriate. All planning must comply with laws of all relevant countries.
