When Do You Need a Power of Attorney in Spain?

Buying Property Without Travelling to Spain

This is the most common reason international clients request a Power of Attorney. Your lawyer receives full authority to sign the public deed (escritura pública) at the notary on your behalf, pay taxes, and register the property at the Land Registry in your name. Many British, Dutch, and French buyers complete their entire purchase from their home country using a Power of Attorney.

If you own property in Spain but live elsewhere, a Power of Attorney allows your lawyer to handle the entire sale — from signing the private contract to completing at the notary, collecting payment, and cancelling mortgages or charges on the property.

When a family member passes away and leaves property or assets in Spain, all heirs must sign the deed of acceptance of inheritance before a Spanish notary. Types of Power of Attorney in Spain

Poder Especial (Special Power of Attorney)

This is the most common type. It authorises your lawyer to carry out one specific transaction — for example, buying a particular property, or accepting a specific inheritance. Once the transaction is completed, the Power of Attorney expires. This is what we recommend for most property purchases and inheritance cases.

Poder General (General Power of Attorney)

This gives your lawyer broader authority to act on your behalf across multiple matters — property management, tax filings, bank accounts, and legal proceedings. It remains valid until you revoke it. We recommend this for clients who own multiple properties or have ongoing legal affairs in Spain.

How to Get a Power of Attorney for Spain

Option 1: At a Spanish Notary

If you are in Spain, you can sign the Power of Attorney directly at a Spanish notary. We draft the document in both English and Spanish, attend the appointment with you, and the notary certifies your signature. Cost: approximately €50–90. Processing time: usually available within 48 hours of booking the appointment.

Option 2: At a Spanish Consulate Abroad

If you are in the UK, France, Netherlands, Belgium, or elsewhere, you can sign at the nearest Spanish Consulate. We send the prepared document to you, you book an appointment at the Consulate, and they certify your signature. The Consulate sends the original to us in Spain.

Option 3: Before a Local Notary With Apostille

You can also sign before a notary in your home country. The document must then be apostilled (certified for international use under the Hague Convention) and, if not in Spanish, officially translated by a sworn translator. This option takes longer but is convenient if there is no Spanish Consulate nearby.

Can I grant a Power of Attorney from the UK after Brexit?

Yes. Brexit has not changed this. You can grant a Power of Attorney at the Spanish Consulate in London, Edinburgh, or Manchester, or before a UK notary with an apostille. The process is exactly the same as before.

Can I revoke a Power of Attorney?

Yes, at any time. You can revoke a Power of Attorney by signing a revocation document before any Spanish notary or Spanish Consulate. Your lawyer can also handle this on your behalf.

Is a Power of Attorney safe? Can my lawyer misuse it?

A properly drafted Power of Attorney limits your lawyer’s authority to specific actions. A Special Power of Attorney for buying one property, for example, cannot be used for anything else. We always recommend using a Special Power of Attorney with clearly defined limits.

How long does a Power of Attorney last?

A Special Power of Attorney expires once the specific transaction is completed. A General Power of Attorney remains valid until you revoke it or until a date specified in the document.
