Many international buyers cannot be physically present for every step of the purchase process. A Power of Attorney (Poder Notarial) allows your lawyer to act on your behalf for specific legal transactions.
What Is a Power of Attorney?
A legal document authorising another person to act on your behalf — sign contracts, make payments, apply for NIE, attend the notary, and handle post-completion formalities.
Types of Power of Attorney
General (poder general) gives broad authority. Specific (poder especial) limits to particular actions — recommended for property purchases as it provides clear limits.
How to Grant One
At a Spanish Notary
Simplest option if you are in Spain. Bring passport, NIE, and details of the authorised person. Immediately valid.
At a Notary in Your Home Country
Must be apostilled (Hague Apostille). UK: through FCDO. Netherlands: Rechtbank. France: Tribunal or Chambre des notaires. May need sworn translation into Spanish.
What to Include
Identify principal and attorney-in-fact, describe specific property and Land Registry reference, state maximum price, authorise signing deed and payments, include NIE authority, and authorise post-completion matters.
Revocation
Can be revoked at any time before a notary. Specific powers expire once the transaction completes.
Is It Safe?
A properly drafted specific Power of Attorney is routine and safe — used in thousands of Spanish property transactions yearly. Ensure it is drafted by an experienced lawyer with professional indemnity insurance.
