How can we help?
Choose what you need
Inheriting a property in Jávea from the United States? We obtain the Spanish certificates, file the Spanish inheritance tax, sign the deed of acceptance for you before the notary if you cannot travel, and register the property in the heirs’ names. Tomas Ballestero Lawyers deals only with the Spanish side, from our office in Jávea and our associated office in Dénia.
InheritanceInheriting a property in Jávea
- CertificatesThe death certificate, apostilled by the Secretary of State of the state that issued it, with a sworn translation; and the Spanish certificate of last wills.
- Inheritance taxSpanish inheritance tax is due within six months of the death. An extension can be requested within the first five months; it is not automatic.
- The deedWe sign the deed of acceptance of the inheritance for you before the notary.
- RegistrationThe property is registered in the heirs’ names at the Land Registry, the municipal plusvalía is paid and the Spanish bank accounts are released.
In personThe NIE
Every foreign buyer, seller, heir or recipient of a gift needs a NIE, the foreigner identification number used on the deed and for the taxes. It is applied for in person, at a Spanish consulate in the United States or in Spain. It cannot be obtained by power of attorney, so if you do not have one yet, it is the one step you have to do yourself.
From the United StatesWhere to sign it
- At a Spanish consulateAt the Spanish consulate that covers your state, before the consul acting as notary. It is valid in Spain without an apostille.
- Before a notary publicBefore a notary public where you live, then apostilled by the Secretary of State of that state and translated into Spanish by a sworn translator, unless the document is already bilingual.
- In SpainIf you are in Spain, at any Spanish notary. The power of attorney can be used straight away.
- The wordingWe draft the text and send it to you in Spanish with an English version, ready to sign.
- The originalThe signed original has to reach us in Spain: a scan or a copy is not enough for the notary.
- RevocationIt can be revoked at any time before a notary.

Our adviceA specific power, not a general one
If you sign by power of attorney, we advise one limited to the inheritance rather than a general one. It gives us what we need to complete for you and nothing more.
