Spanish law (Ley 57/1968 and Ley 20/2015) requires developers to guarantee all advance payments through bank guarantees or insurance. If the developer fails to deliver, your money must be returned with interest. Your lawyer must verify guarantees exist before any payment. This is non-negotiable.

The Payment Schedule

Typically: reservation deposit, then milestone payments (foundations, structure, roof), with the final balance at delivery. Total paid before delivery is commonly 20-30%.

New builds attract VAT (IVA) plus Stamp Duty (AJD), slightly higher than the 10% Transfer Tax on resale properties. Rates may change — verify with your lawyer.
