Buying or selling a property in Altea? Tomas Ballestero Lawyers are independent Spanish conveyancing lawyers who have helped international clients buy and sell property on the Costa Blanca for more than 30 years, from our office in Jávea and our associated office in Dénia, in person or entirely by power of attorney.

BuyingBuying property in Altea: what actually needs checking

Before you pay any deposit we check the nota simple at the Registro de la Propiedad de Altea, the Cadastre, the planning position at the town hall of Altea, and any debts on the property or with the community of owners.

  • Altea Hills and MascaratGated hillside urbanisations with large villas and sea views. We read the community rules and accounts, and check that pools, terraces, retaining walls and extensions match the licence and the registered plot.
  • The seafrontProperties on the coast, from Cap Negret to the Albir side, can fall within the easements of the Ley de Costas. We check the official boundary line against the property before you commit.
  • InlandCountry houses around Altea la Vella and the Sierra de Altea, on non-developable land, raise their own questions: what was built with a licence, what can be regularised and what cannot.
  • Old town housesOlder houses in the historic centre have often been renovated over the years; we check which works were licensed and whether the registry description matches.
  • The seller and the buyerWe confirm that the seller has the power to sell — heirs, co-owners, a company, a power of attorney — and help you decide, before the arras, whose name the property goes into.
  • CompletionThe deed signed before the notary in Altea, in person or by power of attorney, and the registration in your name.

On a villa purchase we always advise an inspection by an architect as well as our legal checks. All of this happens before the deposit contract is signed. The arras deposit is usually 10% of the price: once the arras are signed, the buyer who withdraws loses the deposit, and the seller who withdraws returns it doubled.

SellingSelling property in Altea

We review your papers before the property goes on the market: what is registered against what is built, the certificates a buyer or a notary will ask for, and the community debts. If you are not resident in Spain, the buyer withholds 3% of the price for the tax authorities, and we deal with it and with the plusvalía at the town hall of Altea. We can sign the whole sale by power of attorney.
