Divorce in Spain – Which Country Has Jurisdiction?

For international couples living on the Costa Blanca, one of the first and most important questions in a divorce is not how, but where. The country where you divorce affects the procedure, how your finances are divided, and the arrangements for any children. Choosing well from the start can save years and significant cost.

Where can you divorce?

Within the EU, jurisdiction in divorce is governed by the Brussels II ter Regulation, which generally allows you to divorce in the country of your habitual residence. If you and your spouse are habitually resident in Spain, the Spanish courts will normally have jurisdiction, even if you are British, American, French or Dutch and married elsewhere. In some situations more than one country could have jurisdiction, and then timing matters: the court first seised usually keeps the case.

Spain compared with your home country

Divorcing in Spain is often faster and more economical than many home country systems, and a mutual consent divorce can be resolved relatively quickly through a regulating agreement (convenio regulador). The division of assets, the treatment of pensions, and any maintenance can differ markedly between Spain and your home jurisdiction, which is why advice before filing is valuable rather than after.

Finances and property

Spanish courts will deal with the financial consequences of the divorce, including the family home, maintenance where appropriate, and the economic relationship between the spouses.
