If you buy an apartment, townhouse, or villa in an urbanisation in Spain, you join a Community of Owners (Comunidad de Propietarios), governed by the Ley de Propiedad Horizontal.
What Is a Community of Owners?
The legal entity formed by all owners sharing common elements — pools, gardens, stairways, lifts, parking, and structural elements. Responsible for maintenance, management, and decisions about shared areas.
Community Fees (Cuotas)
Based on your quota de participación. Range from 50 euros/month for small urbanisations to several hundred for luxury developments. Check current fees and planned derramas before buying.
The Annual General Meeting (Junta)
At least one per year: budget approval, accounts presentation, elections, and owner proposals. You can delegate your vote with written authorisation.
President and Administrator
The president is elected by owners and represents the community legally. Many communities hire a professional administrador de fincas for day-to-day management.
Your Rights
Use common areas, attend and vote at meetings, challenge illegal decisions, access accounts, and propose agenda items. You can modify your own property provided it does not affect structure or external appearance.
Your Obligations
Pay fees on time (non-payment can result in legal action and charges on your property), abide by statutes and rules, contribute to derramas, and allow access for maintenance works.
Common Issues on the Costa Blanca
Non-payment by absent owners, short-term rental disputes, disagreements over major repairs, language barriers in international communities, and aging infrastructure in older urbanisations.
What to Check Before Buying
Get a certificate confirming seller is up to date with fees, current fee amount, planned derramas, and any ongoing legal disputes. Essential for understanding true ongoing costs.
